In an interview with Environmental Business Review, Brandon Lucia, Environmental Systems Manager at Cumming Group, discusses the significance of maintaining timely compliance in an era where regulatory mandates around sustainability have become crucial to a business’ operations and overall market performance.
Lucia has been an integral part of the environmental compliance and sustainability efforts for the last 15 years. Beginning his tenure in the public sector, he initially contributed to the Department of Defense, gaining invaluable experience in navigating federal regulations and understanding their intersection with state mandates. Working extensively on the compliance side, this experience provided a solid foundation for comprehending the intricate web of environmental regulations. Now Lucia contributes to the environmental initiatives of the second-largest transportation agency in the United States—L.A. Metro. As a consultant, Lucia is actively engaged in overseeing various facets of their environmental programs, with a primary focus on the implementation and management of the Environmental Management System. Makingmeaningful contributions to the environmental stewardship efforts of a major metropolitan transportation entity, he is poised to bring change.
How can the environmental compliance landscape be improved to address the challenges of slow progress, complex legal language in compliance obligations, and the lack of collaboration between different systems?
The pace of progress in the realm of environmental compliance, unfortunately, can be characterized as relatively slow. Despite the continual influx of new regulations, the methods for retrieving and managing compliance obligations, as well as staying abreast of updates and changes, have not evolved significantly. This stagnant state of affairs underscores the importance of articles like the one under consideration, which shed light on the need for improvement in this domain.
One of the persistent challenges lies in the complexity of compliance obligations. The language employed in these documents is often highly legalistic, making it a formidable task for individuals without legal backgrounds to comprehend. This technical nature of the content can pose a significant barrier, particularly for small businesses in comparison to their larger counterparts.
Another noteworthy issue is the lack of collaboration between different systems. Currently, one might need to navigate through multiple platforms—up to eight, as mentioned—to locate a single compliance obligation along with its associated requirements. This lack of integration and user-friendly accessibility complicates the process for individuals and organizations seeking to understand and adhere to these obligations.
Transparency between organizations is crucial, and I advocate for a shift from a competitive mindset to one of collaboration, fostering a collective and constructive environment.
While the regulatory landscape continues to expand with the addition of new compliance obligations and requirements, there is a notable gap in facilitating the ease of access and comprehension for those affected. Addressing these challenges is crucial to fostering compliance across a spectrum of businesses, making it imperative for the regulatory landscape to evolve in tandem with advancements in technology and collaboration.
How can the integration of technology, specifically artificial intelligence (AI), be optimized to overcome cost barriers and make compliance processes more efficient and accessible for organizations?
A crucial step forward involves leveraging technology. While platforms like Regscan exist to automate compliance processes, their high costs make them inaccessible, especially for smaller organizations with limited resources. Even the use of consultants, a common approach for compliance obligations, can be financially burdensome. To enhance accessibility and efficiency, incorporating AI is key. Despite any reservations about AI, its ability to rapidly analyze vast amounts of data and present it in an organized manner can significantly streamline compliance tasks. Recognizing AI's potential, it becomes imperative to not only embrace its role but also make platforms employing such technology more affordable for businesses of all sizes, rather than catering exclusively to large organizations.
I promote the notion of sustainability costing collaboration and transparency, rather than thick wads of cash. Beyond an idea, it is a reality. Streamlined communication is the lock, stock, and barrel for integrating compliance with all decision-makers regardless of their business size. The nonstop policy overflow has made me appreciate the rapid response time of technology. Incorporating software-based advancements, AI, has helped me optimize this frayed compliance landscape. This smart program enables visual projections of distilled information, a holistic tool for managing regulations.
The market is going to get wilder with upcoming policies, ringing the bells for automated advancements. As it can analyze large datasets in a blink, AI saves the time and manpower required to decipher the complex diction of regulatory policies. It also organizes these details and plays a critical role in reducing the costs required to outsource consultants or hire multiple platforms, making it affordable.
Harnessing AI’s cost viability, I am conducting a Programmatic Evaluation of Compliance (PEC) audit for L.A Metro. Prior to engaging with our solutions in 2021, they were operating with 734 compliance obligations. By 2023, I assisted them in identifying over 2700 regulations, covering a huge gap in updated obligations on paper. Despite being an AI rookie, I was able to comprehend the software-simplified statistics to offer state-of-the-art optimization.
What advice would you offer to clients seeking to stay abreast of the latest trends and technologies in this field?
Stressing on the collaborative model, I encourage the youth’s spirit today which is shifting from a hustler’s mindset to being more inclined with sustainability. This woke, environmentally conscious generation is fostering a life cycle approach that weighs the impact of what they buy and bring into the ecosystem. Holding organizations accountable is one of the critical roles played by the younger customers, forcing business owners to double-check their policies. Their sensible behavior is empowered by technology, through which we can further enforce lucidity.
There’s always someone out there who knows the answer.
Collaboration takes precedence in my recommendations for navigating the complex landscape of environmental compliance and sustainability. I strongly encourage organizations, particularly those in the transportation sector, to engage in collaborative efforts with similar entities. Combining resources for more effective programs is a strategy that I believe is underutilized in the industry. Transparency between organizations is crucial, and I advocate for a shift from a competitive mindset to one of collaboration, fostering a collective and constructive environment.
I also highlight the ubiquity of AI and its accessibility in today's digital landscape. I emphasize the potential for virtually everyone to connect with AI tools via the internet, making it a valuable resource to enhance operational efficiency and stay current with technological advancements.
